You must agree to and accept all of the Terms, or you don't have the right to use the services. Your use of the services in any way means that you agree to all of these Terms, and these Terms will remain in effect while you use the services. Please read on to learn the rules and restrictions that govern your use of our website(s), products, services and applications (the "Services").

You may choose to create a (" Gokwik Account") when You register and avail the Services website utilizing the Services. The information you submit in connection with the Services as well as any other information You saved and passed to Us (collectively, "Information"). Your GoKwik Account remembers important details like contact information, Your Gokwik account ID, for providing an experience that effortlessly moves you through the dashboard for accessing the transaction details.
In order for to communicate with You, You consent to accept and receive communications from us, including e-mail, text messages, calls, and push notifications to the cellular telephone number you provide to us ("GoKwik Messages"). These GoKwik Messages may be delivered by using an automatic telephone dialling system or an artificial or pre-recorded voice at the phone number(s) You provide to GoKwik. These GoKwik Messages may be provided for business purposes and providing the Services and updates associated with Your GoKwik Account and transactions. You consent to accept and receive GoKwik Messages from us using the registered email address and phone number You have provide.
We, along with our licensors where applicable, retain full ownership of all rights, title, and interest in the Services, including the website www.gokwik.co ("Website"), as well as any intellectual property contained therein, whether registered or unregistered. Gokwik grants You a personal, non-exclusive, non-transferable, limited right to access the Platform and use the Website and Services for personal purposes only. You may not remove, obscure, or modify any proprietary notices (including trademark or copyright notices) contained in the Services. All rights not expressly granted herein are reserved. Gokwik retain rights to all trademarks, service marks, logos, trade names, domain names, and other branding elements ("Marks"), and You may not use these without explicit consent. You are prohibited from copying, modifying, creating derivative works from, reverse engineering, distributing, selling, sublicensing, or transferring any part of the Services or Marks. You acknowledge that the Services may contain confidential information, which must not be disclosed without prior written consent.
By providing data, content, trademarks, logos, or other materials ("Your Materials") to Gokwik, You grant a royalty-free, non-exclusive, irrevocable, transferable, and sublicensable license for Gokwik, its Affiliates, and third-party service providers to use such materials to operate, improve, and market the Platform and Services, as well as to fulfil obligations under these Terms. Gokwik may analyse Your Materials and retain ownership of aggregated, anonymized insights. You agree to indemnify Gokwik and its Affiliates for any claims arising from the use of Your Materials in accordance with this clause.
You must be at least 18 years old and legally capable of entering binding agreements to register as a user. You are responsible for maintaining the confidentiality of Your login credentials and for all activities conducted under Your account, whether authorized or not.
You agree to provide and maintain true, accurate, current, and complete information. Gokwik may suspend or terminate Your account if any information is found to be false, incomplete, or outdated.
By providing Your contact information, You consent to receiving marketing communications regarding products and services from Gokwik, its Affiliates, and third parties via electronic or physical channels, including phone, SMS, email, and messaging platforms. This includes explicit waiver of DND/NCPR registration restrictions under TRAI regulations. If you opt out of promotional and marketing messages or emails, please reach out to the Grievance Officer using the details specified in Clause 15 of these Terms.
You authorize Gokwik to share Your information with vendors, service providers, and other third parties as necessary to provide services or offer value-added products. Opt-out requests apply only prospectively.
Gokwik may display tailored offers, promotions, and content from partners based on Your or end-user activity. You consent to such use of data, which may include personal data, for personalized experiences.
Gokwik is not responsible for delivery, after-sales service, invoicing, payments, or other obligations related to Your products or services. You shall indemnify Gokwik for any claims arising from such responsibilities.
You are strictly prohibited from posting, uploading, transmitting, or otherwise making available on or through Gokwik Services or platform any content that violates applicable laws or contains objectionable, infringing, or unlawful material. You shall be solely responsible and liable for any losses, damages, or consequences arising from such violation.
You hereby represent, warrant, and covenant that:
(a) You are duly incorporated, organized, and authorized to conduct business in India.
(b) You have full authority and capacity to enter into these Terms.
(c) The execution of these Terms has been duly authorized.
(d) These Terms are valid and binding.
(a) Your use of the Platform and Services shall comply with all Applicable Laws.
(b) You shall not resell, sublicense, or permit third-party use without Gokwik's prior written consent.
(c) You shall not use the Services for fraudulent or illegal activities.
You warrant that You have obtained consent from Your customers to share their information with Gokwik and relevant authorities for regulatory, fraud prevention, or transactional purposes.
(a) The fees applicable for the provision of Services shall be determined and levied by Gokwik from time to time. You acknowledge and agree that such fees shall be charged in accordance with the manner, rates, and frequency as specified by Gokwik. Gokwik reserves the right, at its sole discretion, to revise or update the applicable fees at any time. The Gokwik fees provide access to the complete suite of payment products, dashboards, and custom reports, where applicable, for payment instruments as prescribed under applicable laws and guidelines.
(b) Fees and Taxes: All fees are exclusive of applicable taxes, and GoKwik shall levy and collect such taxes on the fees as required under applicable law from time to time.
(c) Invoicing and Disputes: GoKwik shall issue monthly invoices for the fees corresponding to the Services provided during the relevant month. Any dispute must be raised within ten (10) days of the invoice date.
(d) For fees deducted upfront, You shall withhold and deposit applicable taxes under Section 194H of the Income Tax Act, 1961 and furnish Form 16A to GoKwik within ninety (90) days.
Use of the Website constitutes consent to the processing of information as described in the Privacy Policy.
GoKwik reserves the right to modify, amend, or update these Terms at its discretion. Any material changes will be communicated through the website or email. Continued use after changes constitutes acceptance.
8.1 GoKwik may suspend or terminate Services immediately under specific conditions, including breach of Terms, unlawful transactions, regulatory instructions, or suspicious activities.
8.2 These Terms remain effective until terminated by either party.
8.3 Termination does not relieve You of prior obligations. Continued use after termination constitutes renewed consent.
The following categories are strictly prohibited: adult content, alcohol, narcotics, counterfeit goods, gambling, weapons, tobacco, cryptocurrencies, pyramid schemes, illegal financial services, and any other activities prohibited under Indian law.
GoKwik or its affiliates may, from time to time, invite You to participate in promotional offers or campaigns. Participation shall be subject to compliance with applicable terms. GoKwik reserves the right to disqualify misuse or violations without prior notice.
All intellectual property rights, including trademarks, copyrights, and patents, vest exclusively in GoKwik or its licensors. You may not copy, reproduce, or distribute any material without prior written consent.
GoKwik may terminate your access without prior notice if you violate these Terms. GoKwik may pursue legal remedies for losses caused by your actions.
GoKwik shall not be liable for indirect, consequential, incidental, or punitive damages. Total liability shall not exceed ₹1000 or the amount paid for Services, whichever is lower.
You shall indemnify and hold harmless GoKwik, its affiliates, and employees against any claims or damages arising from Your breach of Terms, misuse, or violation of applicable laws.
GoKwik shall not be liable for failure to perform obligations due to events beyond its control, including natural disasters, war, hacking, or governmental actions.
These Terms shall be governed by the laws of India. Courts in Delhi shall have exclusive jurisdiction over disputes arising from the use of GoKwik's Platform or Services.
GoKwik provides Services on an 'as is' basis without warranties of any kind. GoKwik does not guarantee uninterrupted, error-free, or virus-free Services and disclaims liability for damages resulting from the use of the Platform.
